1. Acceptance of Terms

By accessing or using MindPalette App ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service you also agree to our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Service

MindPalette App is an emotional wellness platform that allows you to:

• Capture and track daily emotions and moods
• Visualize your emotional journey over time through a personal palette
• Receive AI-powered insights and pattern analysis based on your entries
• Optionally receive daily reminders via email or WhatsApp

The Service may be updated, modified, or expanded at our discretion. We will make reasonable efforts to notify you of significant changes.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information when creating your account
• Maintain the security and confidentiality of your login credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service.

4. User Content & Data

You retain full ownership of all content you submit to the Service, including emotion entries, notes, and personal reflections ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to store, process, and display it solely for the purpose of providing and improving the Service.

• You can export or delete your User Content at any time from your Profile settings
• We do not sell, share, or use your individual entries for advertising
• Anonymized, aggregated data may be used for research and product improvement
• Upon account deletion, your data is permanently removed within 30 days

5. Acceptable Use

You agree not to use the Service in any way that:

• Violates any applicable laws, regulations, or third-party rights
• Involves impersonation of another person or entity
• Attempts to gain unauthorized access to the Service, accounts, or systems
• Reverse-engineers, decompiles, or disassembles any part of the Service
• Uses automated means (bots, scrapers) to access or interact with the Service
• Transmits malware, viruses, or other harmful code
• Interferes with or disrupts the integrity or performance of the Service

We reserve the right to suspend or terminate your account if you violate these terms.

6. Intellectual Property

The Service, including its design, branding, logos, user interface, underlying code, and all related intellectual property, is owned by MindPalette App and protected by applicable intellectual property laws. Nothing in these Terms grants you a right to use our name, trademarks, or other brand elements without prior written consent.

7. Third-Party Services

The Service relies on third-party providers for certain functionality:

• Supabase: Database and authentication infrastructure
• Google: OAuth authentication (Sign in with Google)
• Email & WhatsApp providers: Notification delivery

We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is governed by their respective terms and policies.

8. Disclaimers

MindPalette App is not a medical, therapeutic, or mental health service. It is not a substitute for professional medical advice, diagnosis, or treatment.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. AI-generated insights are for informational purposes only and should not be relied upon as professional advice.

9. Limitation of Liability

To the fullest extent permitted by applicable law, MindPalette App and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or emotional distress, arising out of or related to your use of the Service.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid us, if any, for access to the Service during the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless MindPalette App and its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

You may stop using the Service at any time. You can delete your account from your Profile settings, which will permanently remove your data within 30 days.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination, your right to use the Service will immediately cease.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, please stop using the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Zürich, Switzerland.
